Mumbai Crime News: 71-Year-Old Man Sentenced To 3 Years In Prison For Brutal Attacks On Wife With Sickle
Mumbai: A 71-year-old man was sentenced to three years in prison by a sessions court on Tuesday for attacking his wife. The incident occurred when the man was assaulting his daughter. When his wife intervened to protect their daughter, he attacked her with a sickle.
The sessions judge, Shayana V Patil, said, “The prosecution has proved that the accused has voluntarily caused simple hurt to the complainant by means of a sickle, which is an act punishable u/s 324 of IPC," according to a Hindustan Times report.
In October 2019, the incident happened when her husband, Barhate, came home one evening and began assaulting their daughter with a sickle. When the wife attempted to intervene, he struck her on the left shoulder with the sickle, causing serious injuries. The Mankhurd police subsequently registered a First Information Report (FIR) against Barhate. The wife also alleged that she had been subjected to consistent physical and mental harassment since their marriage, as per the report.
The court observed that while Barhate’s assault was directed at his daughter and not his wife, the prosecution had failed to establish that he had intentionally harmed his wife in an attempt to kill her On the point of cruelty and harassment faced by her after marriage, the court said that the prosecution brought forth no evidence to prove the same.
Evidence such as CCTV footage, an assault weapon, the clothes of the complainant, and medical evidence to prove their case. In her deposition, the wife stated that her husband had threatened to kill her and her daughter after assaulting them.
The session court said that, on March 29, Barhate was sentenced to three years in prison."The prosecution has established that the accused has caused simple hurt to the complainant through a dangerous weapon like a sickle.''
