SIFF Celebrates After Pune Man Wins Alimony Case Against Wife In Indore Family Court

The Save Indian Family Foundation (SIFF), an NGO advocating for men’s rights, celebrated the legal victory of a Pune man in an alimony case.

In a press release, SIFF said Nikunj Shah, a resident of Wakad, won the alimony case against his wife in the Indore Family Court. The court ruled that educated and earning women are not entitled to maintenance.

Sharing details about the case, the NGO stated, "Nikunj, married in January 2016, initially shared a close and loving relationship with his wife. However, after the birth of their son in January 2022, his wife began to act differently. When she visited her parents in February 2022, she started expressing dissatisfaction with her in-laws and began limiting contact between Nikunj’s family and their son. When asked to return, she insisted on living separately from her in-laws, making excuses and false claims of being mistreated by in-laws. Despite efforts by Nikunj to resolve the situation, she maintained her stance, expressing a desire to live independently. Nikunj felt that she was using their son as a tool to push for separation."

"By mid-2023, Nikunj filed for Restitution of Conjugal Rights and Child Custody after being unable to see his son for months. In response, his wife filed multiple false cases, including accusations under Sections 498, Dowry, and IPC 377 (Unnatural Sex), leading to Nikunj's imprisonment in Indore. Nikunj's elderly parents, already battling serious health conditions, endured immense stress during this difficult time. While in jail, he was constantly worried about their well-being. The false cases not only devastated his family emotionally but also disrupted his professional life. Frequent travel to Indore added to his burden, leaving him feeling betrayed and hopeless, as he believed the legal system was unfairly biased against him and his family," the NGO added.

During his time in jail, Nikunj heard of SIFF. With the NGO's guidance, he gained the knowledge to challenge the charges effectively. In court, Nikunj proved that Section 377 of IPC doesn’t apply between spouses. He also exposed his wife's concealed assets, her MBA qualification, her overseas experience and her substantial income.
