Insurance firm told to pay Rs 92L relief to victim’s kin

The Motor Accident Claims Tribunal, Chandigarh, has directed an insurance company to pay a compensation of Rs 92.56 lakh to wife, two children and parents of an Army man who died in an accident three years ago.

Kavita Kaushal, a resident of Kangra district in Himachal Pradesh, in the claim petition filed before the tribunal through advocate Sunil Kumar Dixit said that on June 5, 2021, her husband Sagan Kumar, along with four-five other passengers, was travelling in a car. She said he was coming from his place of posting to Jammu. The driver of the car lost control and it fell into a deep gorge. The accident had taken place solely on account of rash and negligent driving of the driver of the car.

Five persons travelling in the car lost their lives, including her husband. An FIR was also registered. Sagan was around 42 years of age at the time of his death. He was serving in the Army, and at the time of the accident his unit was deputed in Jammu and Kashmir.

He used to get a salary of Rs 73,000 per month. On account of the accident, he received multiple grievous injuries and died on the spot. All claimants have claimed compensation of Rs 1.50 crore along with interest at the rate of 12 per cent.

The owner of the vehicle failed to appear and was proceeded against ex parte.
