Mira Bhayandar News: Police Book Builder For Delivering Flats In Incomplete Building
Mira Bhayandar: The Bhayandar police have booked a builder for delivering flats to buyers in an incomplete building and dragging his feet in finishing the work for more than 20 years.
About The Case
The builder who has been identified as Sanjay Ratilal Jain floated a company named Neelgiri Enterprises and started construction of Tarang Building located in the Padmavati Nagar area of Bhayandar (west) in 2004. He started accepting bookings on the virtue of a commencement certificate issued by the Mira Bhayandar Municipal Corporation (MBMC).
Despite the fact that the building was in an incomplete condition, he started handing over flats to his customers in 2010, with a promise that the pending works, including terrace flooring, RCC water tank, elevators, compound flooring, provision of occupancy certificate, and society formation, would be completed within a year. However, even after continuous follow-ups by the flat owners, the builder allegedly went on dragging his feet and failed to complete the pending works for more than 15 years.
Based on the complaint registered by one of the buyer-Ishwar Porwal, the Bhayandar police registered an offence under the relevant sections of the Maharashtra Ownership Flats (Regulation of the Promotion of Construction, Sale, Management and Transfer) Act-1963 (MOFA) against the builder who is yet to be arrested. Convictions in such cases which are cognizable in nature for criminal breach of trust can invite punishment in the form of imprisonment extending up to three years/ monetary fines or both.
