SC inciting religious wars, crossing limits: BJP’s Dubey
BJP MP Nishikant Dubey on Saturday stoked a controversy by saying Parliament should be shut down if the Supreme Court is to enact laws.
The Godda MP also accused the apex court of “inciting religious wars in the country and crossing its limits which are defined by its powers to interpret the Constitution."
“If the Supreme Court is to make the laws then Parliament House should be shut down," Dubey, BJP’s Godda MP from Jharkhand said.
He asked how the SC could give directions to the appointing authority — the President who appoints the Chief Justice of India.
“Parliament enacts laws. You will dictate to Parliament? Where is it written that the President has to take a decision within three months? This means you want to take this country towards anarchy. When Parliament sits, there will be a detailed discussion on this," Dubey said.
Referring to Section 377 of the IPC, he said the majority people across majority faiths believe “homosexuality is a crime".
“But the SC one fine day abolished Section 377; one day abolished Section 66 A of the IT Act. Now the SC is saying the President should decide in three months. When there is Ram Mandir issue you ask for papers, for Krishna Janmabhoomi you seek papers, for Gyanvapi you need papers, but for mosques built after the Mughal arrival in India, you see where will the papers come from? The SC is responsible for inciting religious wars in this country. Its sole objective is — show me the face and we will show you the law. The SC is crossing its limit which is to interpret the Constitution. And if laws have to be made by the SC, let us close down Parliament," he added.
Congress general secretary Jairam Ramesh slammed Dubey saying the BJP was attempting to weaken the judiciary.
“They (BJP) are busy weakening the Supreme Court. The powers given by the Constitution to the Supreme Court are being sought to be weakened. Those holding constitutional posts, ministers and even BJP MPs are all speaking against the Supreme Court, which is only saying that while making laws, don’t go against the basic structure of the Constitution," Ramesh said.
He said the Congress wants the Supreme Court to be independent and neutral.
“But it is clear that different voices are emerging deliberately to target the Supreme Court," the Congress leader added.
Dubey’s attack on the SC came just two days after Vice-President Jagdeep Dhankhar termed the judiciary “super Parliament" and asked how it could dictate terms to the President of India.
India
